1. Acceptance of Terms
By booking, paying for, or using our services, you explicitly agree to be bound by these Terms & Conditions.
2. Behavioural Services
We provide private dog training and behaviour services primarily at:
- The client’s home
- Local surrounding environments
- Occasional sessions at our nominated location where clients may be invited
We do not operate regular group classes, though group-based participation may occasionally occur.
3. Booking, Cancellations & Credits
- Upfront Payment: Full payment is required upfront to secure and confirm all scheduled sessions.
- No Refunds: All payments are final and non-refundable except where strictly required under Australian Consumer Law.
- Cancellation & Rescheduling Window: A minimum of 48 hours’ notice is required to reschedule a confirmed session.
- Strict Credit Expiration: If a session is cancelled or rescheduled with at least 48 hours' notice, no refund will be issued. Instead, the payment will be held as a business credit. This credit must be used within 30 days of the original cancelled date, or the credit and the session will be permanently forfeited.
- Late Cancellations: Cancellations or rescheduling requests made with less than 48 hours' notice will result in the immediate forfeiture of that session and total loss of payment.
- Exceptions & Transferability: The 30-day credit deadline will not be extended unless official proof is provided that the dog is deceased. However, dog training credits are fully transferable to a third party, provided The Pack Whisperer receives written authorisation from the original customer prior to the new booking.
4. Owner Responsibility & Accountability
You agree that:
- You are entirely responsible for your dog and its actions at all times.
- You will disclose all known behavioural, aggression, or medical issues prior to training.
- You will actively participate in all sessions.
- You will strictly implement all instructions, timing, routines, and environmental structures as demonstrated.
5. Training Outcomes & Guarantee
We guarantee to successfully demonstrate and achieve the foundation behaviours (including Loose Leash Walking, Sit/Stay, Leave It, and Recall) within two (2) sessions, provided instructions are followed.
If you believe these targets have not been met, and you wish to claim additional sessions under this guarantee, you must meet the following strict criteria:
- You must reasonably demonstrate consistent, daily implementation of the training instructions.
- Burden of Proof: You must provide unedited video evidence of you working the dog daily, demonstrating that you are strictly adhering to the provided 28-Day Maintenance Plan.
Upon achieving success in our sessions, the responsibility shifts entirely to the client to maintain the behaviour. This guarantee is strictly void if:
- The 28-Day Maintenance Plan has not been strictly followed.
- The dog develops new, unrelated behavioural or medical issues.
- Environmental or household changes significantly impact the dog's behaviour.
6. Risk & Safety
Dog training involves working with animals that may behave unpredictably. You acknowledge and accept that:
- Dogs may bite, scratch, pull, or act unpredictably.
- There is an inherent risk of injury or property damage.
- You participate entirely at your own risk and must follow all safety instructions.
We reserve the right to refuse, suspend, or terminate training immediately at any time if safety is compromised.
7. Liability
To the maximum extent permitted by law:
- We are not liable for any injury, loss, or damage arising from participation in training.
- We are not responsible for the dog's behaviour outside of face-to-face training sessions.
- You are solely responsible for the correct and safe implementation of the training methods.
Nothing in these Terms limits rights under Australian Consumer Law that cannot be excluded.
8. Health Requirements
You confirm your dog is:
- Healthy, fit for training, and free of infectious diseases.
- Up to date with vaccinations and parasite prevention where appropriate.
We may refuse service if a dog presents an active health or safety risk.
9. Intellectual Property
All training methods, materials, handouts, and digital content remain the exclusive property of The Pack Whisperer and may not be copied, shared, or used commercially without express written authorisation.
10. Governing Law
These Terms are governed by the laws of Queensland, Australia.
