1. Acceptance of Terms

By booking, paying for, or using my services, you explicitly agree to be bound by these Terms & Conditions.

2. Behavioural Services

I provide dog training and behaviour services at:

The client’s home

Local surrounding environments and public spaces

Nominated locations where clients may be invited

3. Booking, Cancellations & Credits

Upfront Payment: Full payment is required upfront to secure and confirm all scheduled sessions.

No Refunds: All payments are final and non-refundable except where strictly required under Australian Consumer Law.

Cancellation & Rescheduling Window: A minimum of 48 hours’ notice is required to reschedule a confirmed session.

Strict Credit Expiration: If a session is cancelled or rescheduled with at least 48 hours' notice, no refund will be issued. Instead, the payment will be held as a business credit. This credit must be used within 30 days of the original cancelled date, or the credit and the session will be permanently forfeited.

Late Cancellations: Cancellations or rescheduling requests made with less than 48 hours' notice will result in the immediate forfeiture of that session and total loss of payment.

Exceptions & Transferability: The 30-day credit deadline will not be extended unless official proof is provided that the dog is deceased. However, dog training credits are fully transferable to a third party, provided I receive written authorisation from the original customer prior to the new booking.

4. Owner Responsibility & Accountability

You agree that:

Primary Control: You are entirely responsible for your dog and its actions at all times.

Active Participation: You will actively participate in all sessions and strictly implement all instructions, timing, routines, and environmental structures as demonstrated.

Full Behavioural & Bite History Disclosure: You warrant and declare that you have fully disclosed to me prior to training any known history of aggression, bite incidents (towards humans or other animals), resource guarding, or reactivity. You confirm whether your dog has ever been declared a "menacing" or "dangerous" dog under the Animal Management (Cats and Dogs) Act 2008 (Qld) or any local council declaration.

Right to Terminate for Non-Disclosure: Failure to disclose known aggressive tendencies, bite history, or medical conditions prior to the session constitutes a material breach of these Terms. I reserve the right to terminate training immediately without refund if undisclosed severe aggression or safety hazards emerge.

5. Public & Off-Premises Training

Authorisation: You authorise training sessions to take place in public settings, including local parks, footpaths, cafes, and surrounding community areas.

Legal Control & Council Bylaws: At all times during off-premises training, you retain legal ownership and physical control of your dog. You are solely responsible for ensuring compliance with all local council bylaws (including leash laws, picking up waste, and keeping the dog under effective control).

Third-Party Incidents: You remain entirely financially and legally liable for any injury, damage, or distraction your dog causes to third parties, other animals, or public property while transitioning to or training in public locations.

6. Training Outcomes & Guarantee

I guarantee to successfully demonstrate and achieve the foundation behaviours (including Loose Leash Walking, Sit/Stay, Leave It, and Recall) within two (2) sessions, provided instructions are followed.

If you believe these targets have not been met, and you wish to claim additional sessions under this guarantee, you must meet the following strict criteria:

You must reasonably demonstrate consistent, daily implementation of the training instructions.

Burden of Proof: You must provide unedited video evidence of you working the dog daily, demonstrating that you are strictly adhering to the provided 28-Day Maintenance Plan.

Upon achieving success in my sessions, the responsibility shifts entirely to the client to maintain the behaviour. This guarantee is strictly void if:

The 28-Day Maintenance Plan has not been strictly followed.

The dog develops new, unrelated behavioural or medical issues.

Environmental or household changes significantly impact the dog's behaviour.

7. Risk & Safety

Dog training involves working with animals that may behave unpredictably. You acknowledge and accept that:

Inherent Risk: Dogs may bite, scratch, lunge, pull, or act unpredictably, creating an inherent risk of injury or property damage. You participate entirely at your own risk and must follow all safety instructions.

Safety Equipment: You agree to utilise all safety equipment recommended by me (including muzzles, long lines, harnesses, slip leads, or specific management tools) exactly as demonstrated. If you refuse to apply required safety equipment, I reserve the right to end the session immediately with full loss of the session fee.

Right of Refusal: I reserve the right to refuse, suspend, or terminate training immediately at any time if safety is compromised.

8. Liability & Indemnification

To the maximum extent permitted by law:

Limitation of Liability: I am not liable for any direct, indirect, incidental, or consequential injury, loss, or property damage arising from participation in training sessions or your implementation of training advice outside of face-to-face sessions.

Responsibility Outside Sessions: I am not responsible for the dog's behaviour outside of face-to-face training sessions.

Correct Implementation: You are solely responsible for the correct and safe implementation of the training methods.

Indemnification (Hold Harmless): You agree to indemnify, defend, and hold harmless The Pack Whisperer against any and all claims, demands, liabilities, costs, or expenses (including legal fees on a solicitor-client basis) arising from third-party claims, dog bites, or property damage caused directly or indirectly by your dog during or following training sessions.

Statutory Rights: Nothing in these Terms excludes, restricts, or modifies any consumer rights or statutory guarantees under the Competition and Consumer Act 2010 (Cth) or the Australian Consumer Law that cannot lawfully be excluded.

9. Health Requirements

You confirm your dog is:

Healthy, fit for training, and free of infectious diseases or contagious parasites.

Up to date with vaccinations and parasite prevention where appropriate.

I may refuse service if a dog presents an active health or safety risk.

10. Intellectual Property

All training methods, materials, handouts, and digital content remain the exclusive property of The Pack Whisperer and may not be copied, shared, or used commercially without my express written authorisation.

11. Media, Recording & Marketing Content

11.1 Collection of Anonymous Media by The Pack Whisperer

Anonymous Capture: During sessions (whether at the client’s home, surrounding environments, or my nominated location), I may capture short video clips and photographs of the dog and handler mechanics for educational, promotional, and social media purposes.

Anonymity Guarantee: To protect your privacy, all media captured by me will be strictly framed from the waist down or focused directly on the dog. Your face will not be displayed or made identifiable in any of my public marketing materials.

Scope & Location: You grant permission for me to record these anonymous clips, including brief threshold or entrance movements (such as exiting or entering a doorway), provided no house numbers or identifiable personal address features are visible.

Ownership: All recorded video footage and photographs taken by me remain the exclusive intellectual property of The Pack Whisperer.

11.2 Client Recording & Filming Prohibitions

Prohibition of Recording: To protect proprietary training methodologies, intellectual property, and personal privacy, clients, household members, and associated third parties are strictly prohibited from video recording, filming, or audio recording any portion of a training session without my express, prior written consent.

Unauthorised Footage: Any unauthorised audio or video recording captured during a session must be deleted immediately upon request.

Approved Personal Reference Footage: In the event that written permission is granted for a client to film specific mechanics for personal practice, that footage is strictly for private, non-commercial use and may not be published, broadcast, uploaded to social media, or distributed publicly.

Termination for Non-Compliance: I reserve the right to immediately suspend or terminate a training session without refund if a client or bystander refuses to cease filming or recording after being requested to do so.

These Terms are governed by the laws of Queensland, Australia.
